1. Acceptance of Terms

By accessing or using the App, you confirm that:

  • You have read and understood these Terms.
  • You are legally capable of entering a binding agreement.
  • Your use of the App signifies acceptance of these Terms and Apple's Standard End User License Agreement (EULA).

2. Description of Service

TryOn AI allows users to:

  • Upload a model image
  • Upload a clothing/product image
  • Generate an AI-created image showing the model wearing the clothing item ("AI Output")

The App uses artificial intelligence. The AI Output may not always be accurate, realistic, or error-free.

3. User Responsibilities

3.1 Ownership of Uploaded Content

You agree that you:

  • Own or have permission to use any images you upload
  • Are responsible for ensuring your images do not violate copyrights, trademarks, or privacy rights

You remain the owner of the content you upload and the AI Output generated from it.

3.2 Acceptable Use

You must not:

  • Upload illegal, harmful, explicit, hateful, or abusive content
  • Upload images of individuals without their permission
  • Use the App to impersonate people or create misleading/deceptive content
  • Attempt to hack, reverse-engineer, or extract source code
  • Use generated images for unlawful purposes

You are fully responsible for how you use the App.

4. Image Processing & Data Handling

To generate AI Output, the App may process your images locally or temporarily on a secure server.

4.1 Photos

  • Uploaded images are used only to generate results
  • They are automatically deleted from our servers immediately after processing
  • We do not store, reuse, sell, or share your uploaded images

5. Third-Party Services

The App may use third-party services. These services have their own Terms & Privacy Policies. We are not responsible for their practices.

6. Internet Connection & Charges

Some features require an active internet connection. You are responsible for:

  • Data charges
  • Roaming charges
  • Ensuring stable internet access

TryOn AI is not responsible if the App does not function due to poor connectivity.

7. Ownership & Intellectual Property

All intellectual property related to the App—including software, code, design, logos, text, and graphics—belongs to TryOn AI.

You may not:

  • Copy or modify the App
  • Decompile or reverse-engineer
  • Create derivative works
  • Reproduce or distribute any part of the App

All rights are reserved.

8. Updates

We may release updates, improvements, feature changes, or bug fixes at any time. You agree:

  • To install updates to continue using the App
  • That we may discontinue features or the App entirely without prior notice

Upon discontinuation or termination, your rights to use the App end immediately.

9. Pricing, Subscriptions & Payments

  • Payments are handled solely by Apple through the App Store
  • TryOn AI does not collect or store payment information

10. Refund Policy

All payments and refunds follow Apple's App Store policies. TryOn AI cannot issue or approve refunds directly.

11. Limitation of Liability

To the fullest extent permitted by law, TryOn AI is not liable for:

  • Loss of data
  • Device damage or performance issues
  • Inaccurate or imperfect AI Output
  • Server or third-party service failures
  • Any indirect, incidental, or consequential damages

You use the App at your own risk.

12. Apple App Store Terms

You acknowledge the following:

  • These Terms are between you and TryOn AI only, not Apple
  • Apple is not responsible for the App's content or performance
  • Apple has no obligation to provide maintenance or support
  • Apple is not responsible for any claims by you or third parties
  • In case of warranty failure, you may notify Apple, and Apple may refund the purchase price
  • Apple and its subsidiaries are third-party beneficiaries of these Terms

Upon acceptance of these Terms, Apple has the right to enforce them against you.

13. Governing Law

These Terms are governed by the laws of Bangladesh, unless local laws in your country require otherwise.

14. Termination

We may suspend or terminate your access if:

  • You violate these Terms
  • You misuse the App
  • We discontinue the App or any part of the service

You may delete the App at any time to stop using it.

15. Changes to Terms

We may update these Terms at any time. Changes will be posted inside the App or on our website. Continued use after updates means you accept the revised Terms.
